Despite
the clear, overwhelming voice of its faculty, Park Park management has no
intention of allowing the union to negotiate a contract.
Now, however,
university officials have lost Round 4 and have been ordered yet again to
begin bargaining. Instead, the school decides to file a court
appeal.
Meanwhile, faculty leaders begin to wonder how much
student activity fee money is actually going toward paying union-blocking
legal fees, a bill that now stands at nearly a half-million dollars.
The NLRB on Feb. 17 found that Point Park was in
violation of federal labor law and ordered the college administration to
bargain with the Guild.
The college again refused to obey the federal order
and instead appealed the decision to the U.S. Circuit Court of Appeals
in Washington. Point Park has already submitted its brief, as has
several groups that represent college administrators. The NLRB's brief
is due in early September. The Guild is filing a joint brief with the
AFL-CIO and the assistance of the American Federation of Teachers, the
American Association of University Professors and the National Education
Association.
The NLRB ruling in February continues the Guild's series of
victories since 67 fulltime Point Park faculty voted overwhelmingly to
join the union last June. Unfortunately, the college administration has
chosen to defy the law and refuses to bargain with the Guild.
After the most recent NLRB ruling, the Guild
immediately renewed our request to begin bargaining with the college,
which the college refused. Instead, the college and its hired legal
gun, Arnold Perl of Memphis, filed a request with the federal D.C.
Circuit Court of Appeals for a judicial review of the NLRB's ruling.
So, we wait. Meanwhile, Guild members are preparing
mobilization strategies to get our message out to the students and
community about the Point Park administration's decision for disobey
federal law.
