1. The term Library Clerk shall be replaced by the term Library Associate. The four-year step-up will continue as in the past.

2. Associates will perform those assignments as directed by their supervisors. It is understood that some of those assignments will be identical to assignments performed by other members of the library staff and may include the marketing and sale of products and services.

3. The four-year step-up is not an apprenticeship. There are no guarantees that a library associate will be promoted to an information specialist.

4. Applicants for the position of information specialist should have either five years of newspaper library experience or a master's degree in library or information science or marketing.

MEMORANDUM OF UNDERSTANDING

PG Speakers' Bureau Policy

(March 2, 1995)

Staffers making speaking appearances involving their professional role as staff members of the Pittsburgh Post-Gazette will be compensated when the appearance has been scheduled through the Post-Gazette Speakers' Bureau.

Appearances scheduled during the staff member's regular working hours will be compensated at $25. Appearances scheduled during the staff member's non-working hours will be compensated at $50. No mileage, parking or meal costs will pertain. In the case of out-of-town appearances, the Speaker's Bureau will attempt to make arrangements for the organization to provide reimbursement of travel expenses.

Staffers contacted for a speaking engagement must first refer the inquiring party to Barbara Bobucki, assistant to the editor, who will set up the details and review the eligibility. The Marketing Department will also develop speaking engagements for staffers on her own by publicizing the Bureau in the paper and through a mail-out brochure. The minimum recommended group size for eligibility is 25. Academic classes will be given separate consideration.

The Speaker’s Bureau will negotiate fees with groups and set up a share with the staffer over and above the minimums on a case-by-case basis. The idea is for these appearances to help underwrite appearances before groups in our community that cannot afford to pay such fees. After clearing its costs each year, the Bureau will donate any remaining newspaper share of bureau revenues to PG charities.

Staffers who have already made their own arrangements to speak before groups in the community before March 3, 1995 would be free to meet those commitments. However, they must notify Barbara about these arrangements right away

Staffers interested in participating in the Speakers' Bureau should contact Barbara and let her know that they would like to participate as soon as possible.

MEMORANDUM OF UNDERSTANDING

1.     Woodene Merriman, an assistant managing editor, will continue writing the microwave column and will rejoin the Guild effective May 1, 1987, as a dues-paying member.  Woodene will remain in the Guild until January 1, 1988.

2.     Paragraph D, Preamble – This language will become part of the contract when a new contract is signed.

      B.     The kind of work either normally, or presently, performed within the unit covered by this Agreement and other work assigned to be performed within said unit, or work which replaces or displaces such work, is recognized as the jurisdiction of the Guild, and performance of such work shall be assigned to employees within the Guild’s jurisdiction.  This clause is not intended to change any past practices regarding the sports editor and the occasional use of stories written by exempt employees (special reports, personal travel reports, analytical pieces, insights and sidebars) or to preclude exempt employees from writing specialty columns on a regular basis as set forth hereinafter.  Regular basis shall mean weekly columns.  Specialty columns shall mean anything involving special expertise in what might normally be considered bargaining unit work.  In no event, however, shall the number of exempt employees writing specialty columns exceed a ratio of one non-bargaining unit employee to every 42 dues-paying Guildsmen.

 3.     Effective with the signing of a new labor agreement, the company will increase the pension plan benefit formula from the present 1.2 percent to 1/3 percent if this increase can be accomplished with no more than $1.25 in new money.  (This adjustment actually increases an individual’s pension by 8.4 percent.  Topper, for example, would have received $1,010 under the new formula instead of $933, a monthly increase of $77.)

Mr. Mike Bucsko

Grievance Committee Chairman

Newspaper Guild of Pittsburgh

Local 38061

Dear Mike:

The purpose of this letter is to address the issue of news assistant Rick Nowlin being given the opportunity to work as a two-year intern as defined in Article X of the contract.

Because the contract doesn’t anticipate a copy messenger, clerk or news assistant working as a two-year intern, it is necessary to establish guidelines for Rick’s tenure as a two-year associate (intern).  They are as follows:

*Rick’s salary will follow the contractual increases of a news assistant

*Rick will continue to receive a vacation bonus as well as his earned vacation.

*At the end of the two-year internship, Rick will remain in the bargainin unit unless he chooses to terminate his employment at the Post-Gazette.  The purpose of this guideline is to clearly state that Rick will not be required to resign at the conclusion of his two-year internship.

*Rick will be covered by all the provisions of the labor agreement, but also will be permitted to work in the same classifications as the other two-year interns.  The purpose of this guideline is to clearly state that Rick is protected by the Security language in the contract (Rick will be treated the same as a regular full time employee with seniority dating back to his date of hire) and that the Company has the right to assign Rick to work in the same classifications as the other two-year interns.

This Memorandum of Understanding is in addition to the Labor Agreement effective January 1, 1998, between the Newspaper Guild of Pittsburgh and the Pittsburgh Post-Gazette.  Effective January 1, 2001, the Company and the Guild agree as follows:

 1.     All employees hired during 2000 who are covered by Article XII of the contract (Holidays) are entitled to the Birthday holiday in 2001.

 2.     All eligible employees hired after January 1, 2001, will be entitled to their Birthday holidays in the next calendar year.  For example, one employee is hired January 3, 2001, and another employee is hired December 30, 2001; both are entitled to their Birthday holidays in 2002.

 3.     Although the intention of the Birthday holiday was for an employee to take his Birthday as the holiday, the practice has been to use the Birthday holiday as a personal day.  Therefore, with this MOU, all eligible employees may use their Birthday holidays as personal days.

 4.     The 12-month waiting period for personal days is waived for the Birthday holiday.

MEMORANDUM OF UNDERSTANDING

This Memorandum of Understanding between the Pittsburgh Post-Gazette and the Newspaper Guild of Pittsburgh is entered into for the sole purpose of addressing the particular need of the Publisher for layoffs of 15 part-time employees in January, 2002.  The Company and the Guild agree as follows:

1.      This Memorandum of Understanding does not replace or modify the MOU of March 26, 2001, except to the extent allowed herein.

2.      All fifteen part-time employees laid off in January, 2002, will be placed on a rehire list through December 31, 2003.  This date may be extended by mutual agreement.  Recall will be based on seniority.

3.      The 10 laid off writers may continue to do their regular assignments as stringers and will be paid—through the stringer pay system—at the same rate they received as part-time employees.  The laid off copy reader will be permitted to use Company equipment to perform her assignments and will be paid through the stringer pay system.  The laid off clerical person is covered under existing contract language.

4.      The laid off part-time employees who are entitled to vacation days will receive those vacation days as time off with pay at mutually agreeable times between them and the Company.

5.      The stringer/freelance agreement that must be signed by all stringers will include the amount of money that each of the 12 stringers will receive per week/month, etc.

6.      If a person is hired for an exempt position, the Company will immediately recall six of the laid off part-time employees.

7.      It is understood by both parties that this MOU does not replace the current language regarding bargaining unit work, specifically the last sentence in the first paragraph of Section 3 in Article VIII; “Stringers and free lancers in no case will replace or displace bargaining unit employees.”  Furthermore, this agreement to allow stringers to do bargaining unit work applies ONLY to the 12 part-time employees who were laid off and has no bearing on any other stringer/free lance arrangements.

The Company will assume jurisdiction over photo reprints.  For clarification, this involves all work performed by image techs and photographers that is associated with the creation and distribution of photo reprints.

The Company will gain another exempted employee as described in Paragraph C of the Preamble (this will increase the number of such exemptions allowed to two), with the following provision: the Company will have until December 31, 2006, to name a current employee to this exempt status.  If the Company does not exercise this option prior to the expiration of this Agreement, the right to name an exempted employee under Paragraph C will be limited to a new hire.

All employees covered by the Labor Agreement will receive personal holidays as described in Article XII, Paragraph 1. Paragraph 5 of Article XII is no longer applicable.  The clear intention of this language is give part-time employees the same personal holiday benefits as full-time employees.

Effective January 1, 2005, employees covered by this Labor Agreement with 15 or more years of Post-Gazette service will receive another personal holiday.

                                MEMORANDUM OF UNDERSTANDING

Editorial Page Associate & Sports Agate Differential

The Post-Gazette and the Guild recognize the need to create the position of Editorial Page Associate.  The Editorial Page Associate job description is as follows:

The associate would attend meetings of the editorial board, pose editorial topics, discuss positions that the newspaper should take and write editorials.  He or she would also have the opportunity to write signed pieces for the opinion pages.

The associate would be a backup paginator to assemble copy and lay out pages in the absence of the oped editor and letter editor, primarily due to vacation, illness and other days off.  This would require training in pagination and maintaining those skills by regularly using them.

The associate would assist with general tasks like communicating with letter writers and free-lance opinion writers, inputting hard copy, answering the phone, greeting visitors and scheduling meeting space.

The parties agree to the creation of the Editorial Page Associate with the following limitations:

 This position is excluded from the operation of Article 10, Section 3D of the Collective Bargaining Agreement;

The position will be in effect for 2 years and then be eliminated, subject to further discussion between the parties.

In the event the position becomes vacated prior to the 2 year period, the position will go vacant at that time, subject to discussion between the parties.

If the Post-Gazette decides to hire the Editorial Page Associate on a full time basis during this 2 years period, the person will have to be hired either as a paginator or a writer.

In exchange for this Editorial Page Associate position, the Post-Gazette and the Guild agree to the following regarding the Sport Agate Clerk on a non precedental, non prejudicial basis:  The Post-Gazette agrees to pay the contractual $4.00 a day differential  known as “others not fully experience rated” up to a total of seven shifts a week for the sport agate clerk position.  This is to compensate for the placing of the agate composition straight onto the page through the DTI system.  This payment is retroactive to the payroll week beginning June 13, 2004.

The parties agree that if a potential exists in other departments to have such differentials because of the DTI system, they will meet to discuss the possible implementation of the differential.  The parties also recognize that each individual case stands on its own.
